These Terms of Use (“Terms”) are an agreement between you and Giani, a product operated by Moonrise Labs Inc.(“Giani,” “we,” “us,” or “our”). They govern your use of the Giani iOS application and the website at giani.app (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use Giani
You must be at least 13 years old (or 16 in the EEA / UK) to use Giani. By using Giani you represent that you meet this age requirement and that you have the authority to agree to these Terms.
2. Your account
You sign in to Giani using Sign in with Apple or Sign in with Google. You are responsible for the activity that happens under your account and for keeping access to your Apple / Google account secure. Please notify us at support@giani.app if you suspect unauthorized use.
3. The App Store EULA
Because Giani is distributed through the Apple App Store, the Apple Licensed Application End User License Agreement (“Apple EULA”) also applies to your use of the Giani iOS app. In case of conflict between the Apple EULA and these Terms, the Apple EULA controls for the iOS app. You acknowledge that Apple is not responsible for the app, its content, or any claims about it.
4. License to use Giani
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Giani on devices you own or control, for your own non-commercial learning and enjoyment.
5. Things you can’t do
- Copy, modify, reverse-engineer, decompile, or create derivative works from the Service, except to the extent that law allows despite this restriction
- Resell, rent, lease, or sublicense the Service
- Use the Service to harass, harm, impersonate, or violate the rights of others
- Attempt to gain unauthorized access to Giani, other users’ accounts, or our infrastructure
- Scrape, crawl, or bulk-download content in a way that harms the Service or its users
- Submit content through feedback that is illegal, defamatory, discriminatory, or violates anyone’s rights
6. Content
All questions, answers, explanations, illustrations, mascots, audio, and branding in Giani are owned by us or licensed to us. Cultural and historical facts are not owned by anyone, but the way Giani selects, arranges, and presents them is protected.
If you submit feedback, ideas, or suggestions, you grant us a worldwide, royalty-free, perpetual license to use them to improve the Service without any obligation to you.
7. Accuracy of content
Giani teaches Punjabi culture, history, Sikhi, language, food, and festivals. We do our best to keep the content accurate and respectful, but we cannot guarantee that every question, translation, or cultural note is perfect. If you spot something wrong, please tell us via in-app feedback or email.
8. Price and changes
Giani is currently free. If we introduce paid features in the future, any digital purchases made inside the iOS app will be processed through Apple’s In-App Purchase system in accordance with the App Store guidelines. Pricing and terms will be clearly disclosed to you before you pay anything. We may change, suspend, or discontinue parts of the Service at any time.
9. Termination
You can stop using Giani at any time and delete your account (see our Privacy Policy). We may suspend or terminate your access if you violate these Terms, if required by law, or if we reasonably believe your use is harming the Service or other users.
10. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service. We do not warrant that the Service will be error-free or that content is accurate or complete.
11. Limitation of liability
To the fullest extent permitted by law, Giani and its creators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) what you paid us in the 12 months before the claim, or (b) CAD $50.
12. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms.
13. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. Courts located in Ontario will have exclusive jurisdiction over disputes, unless applicable consumer-protection law requires otherwise.
14. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the app. Continued use of the Service after a change means you accept the updated Terms.
