These Terms of Use (“Terms”) are an agreement between you and Giani, a product operated by Moonrise Labs Inc.(“Giani,” “we,” “us,” or “our”). They govern your use of the Giani iOS application and the website at giani.app (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Who can use Giani
You must be at least 13 years old (or 16 in the EEA / UK) to use Giani. By using Giani you represent that you meet this age requirement and that you have the authority to agree to these Terms.
2. Your account
You can sign in to Giani with Sign in with Apple, Sign in with Google, or an email address and password. You are responsible for the activity that happens under your account and for keeping your Apple ID, Google account, or password secure. Please notify us at support@giani.app if you suspect unauthorized use.
You pick a username and may add a profile photo. Those are how other people see you in Pinds, on leaderboards, and in 1v1. Keep them appropriate. We may reject or change a username or photo that breaks these Terms.
3. The App Store EULA
Because Giani is distributed through the Apple App Store, the Apple Licensed Application End User License Agreement (“Apple EULA”) also applies to your use of the Giani iOS app. In case of conflict between the Apple EULA and these Terms, the Apple EULA controls for the iOS app. You acknowledge that Apple is not responsible for the app, its content, or any claims about it.
4. License to use Giani
Subject to these Terms, we grant you a personal, limited, non-exclusive, non-transferable, revocable license to install and use Giani on devices you own or control, for your own non-commercial learning and enjoyment.
5. Things you can’t do
- Copy, modify, reverse-engineer, decompile, or create derivative works from the Service, except to the extent that law allows despite this restriction
- Resell, rent, lease, or sublicense the Service
- Use the Service to harass, harm, impersonate, or violate the rights of others
- Use a username, profile photo, Pind name, or other profile content that is illegal, hateful, sexual, threatening, or impersonates someone else
- Cheat, script, exploit bugs, or create multiple accounts to manipulate rating, matchmaking, leaderboards, or streaks
- Attempt to gain unauthorized access to Giani, other users’ accounts, or our infrastructure
- Scrape, crawl, or bulk-download content in a way that harms the Service or its users
- Submit content through feedback that is illegal, defamatory, discriminatory, or violates anyone’s rights
6. Content
All questions, answers, explanations, illustrations, mascots, audio, and branding in Giani are owned by us or licensed to us. Cultural and historical facts are not owned by anyone, but the way Giani selects, arranges, and presents them is protected.
You keep whatever rights you already have in the username, profile photo, Pind name, and other content you add (“Your Content”). You grant us a worldwide, royalty-free license to host, store, display, and share Your Content with other users as needed to run the Service — for example on leaderboards, in Pinds, in 1v1, and on a friend’s lock screen when you challenge them. That license lasts for as long as Your Content is on Giani. You can change or remove a photo, and you can delete your account.
If you submit feedback, ideas, or suggestions, you grant us a worldwide, royalty-free, perpetual license to use them to improve the Service without any obligation to you.
7. Playing with other people
Giani includes social features: Pinds (small groups), friend and Pind 1v1 challenges, and ranked 1v1 matchmaking (Mukabla). When you use those features, other people can see your username, profile photo, rating, streak, and whether you have Giani Pro (the Super badge).
Ranked matchmaking may pair you with another player or with a practice opponent. Leaving a live match or going idle can count as a forfeit and may change your rating. Ranked matches can move your rating; friend / Pind 1v1s do not.
There is no public chat. If someone’s username, photo, or behavior breaks these Terms, report them from their profile in the app or email support@giani.app. We may remove content or suspend or terminate accounts that harm other users or the Service.
8. Accuracy of content
Giani teaches Punjabi culture, history, Sikhi, language, food, and festivals. We do our best to keep the content accurate and respectful, but we cannot guarantee that every question, translation, or cultural note is perfect. If you spot something wrong, please tell us via in-app feedback or email.
9. Giani Pro
Giani is free to download and use. The Daily set, Pinds, and 1v1 stay free whether or not you pay.
Giani Pro is an optional Apple subscription. While Pro is on, you get unlimited custom sets, unlimited replays per set, and no ads. Without Pro, you can make 2 custom sets total and replay once a day, and you will see ads. How we handle advertising data is described in our Privacy Policy.
Pro is $4.99 per month or $39.99 per year (USD list price; Apple may show a localized price). Purchases are billed by Apple through In-App Purchase. Pro renews automatically at the end of each month or year unless you cancel first. Pricing is shown in the app before you pay.
Yearly Pro may include a 7-day free trial. Whether you are eligible is decided by Apple, and the trial length is shown in the app before you confirm. When the trial ends, it becomes a paid $39.99 per year subscription automatically unless you cancel at least 24 hours before it ends. If you cancel during the trial you are not charged, and you keep Pro until the trial period runs out. Apple allows one trial per subscription group per Apple ID, so a second trial is not available if you subscribe again later.
We may change, suspend, or discontinue parts of the Service (including ads, Pro, and what Pro includes) at any time.
10. Cancellation and refunds
You can cancel Pro at any time in iOS Settings → [your name] → Subscriptions. Pro stays on until the month or year you already paid for ends. Then you drop back to the free caps: 2 custom sets total, 1 replay a day, and ads. If you are on a free trial, cancelling before it ends means you are never charged.
Cancel is not a refund. Unused days of that month or year are not paid back. You already got Pro for the period you paid for. Yearly Pro is $39.99 for a whole year of skipping those two walls, not a day-by-day credit.
We do not refund Pro. Apple billed the purchase, so Apple decides. To request a refund, go to reportaproblem.apple.com. If you hit a limit by mistake and bought yearly, Apple can still refund; Giani does not have a special unused-time rule.
If Apple issues a refund, Pro turns off. You keep the free app. You do not keep unlimited custom sets, unlimited replays, or no ads after Apple refunds.
11. Termination
You can stop using Giani at any time and delete your account (see our Privacy Policy). We may suspend or terminate your access if you violate these Terms, if required by law, or if we reasonably believe your use is harming the Service or other users.
12. Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, or uninterrupted service. We do not warrant that the Service will be error-free or that content is accurate or complete.
13. Limitation of liability
To the fullest extent permitted by law, Giani and its creators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or related to your use of the Service. Our total liability for any claim relating to the Service will not exceed the greater of (a) what you paid us in the 12 months before the claim, or (b) CAD $50.
14. Indemnity
You agree to indemnify and hold us harmless from any claims, losses, or expenses (including reasonable legal fees) arising from your misuse of the Service, Your Content, or your violation of these Terms.
15. Governing law
These Terms are governed by the laws of the Province of Ontario, Canada, without regard to its conflict-of-laws rules. Courts located in Ontario will have exclusive jurisdiction over disputes, unless applicable consumer-protection law requires otherwise.
16. Changes to these Terms
We may update these Terms from time to time. If we make material changes, we will update the “Last updated” date and, where appropriate, notify you in the app. Continued use of the Service after a change means you accept the updated Terms.
